Tax litigation
Expertise to support the defence of clients
The firm assists its clients throughout litigation proceedings before French courts (administrative courts, ordinary courts and the Constitutional Council) and European courts (Court of Justice of the European Union, European Court of Human Rights).
On the one hand, the firm assists its clients in challenging the validity of tax assessments issued by the tax authorities (disputes concerning the tax base). If you wish to challenge the findings of a tax audit, we will support you through this process.
Furthermore, the firm also assists its clients in challenging collection measures implemented by the tax authorities to recover their claims (collection litigation) and ensures, in particular, that the tax authorities’ right to take collection action has not become time-barred. Collection litigation requires rigour and speed: collection measures can only be challenged within two months of their notification. If you are surprised by the measures taken by the tax authorities to recover past contributions, we can assist you with this process.
In tax matters, bringing a case before the competent courts requires the prior submission of a claim, which formalises the taxpayer’s objection. It is therefore important to be assisted by a tax lawyer from the moment the claim is lodged, in order to comply with the applicable procedural rules.
Our support covers the following areas:
Drafting the complaint addressed to the tax authorities
Referral to the competent courts
